Terms of Service

Agreement to terms

These Terms of Service ("Terms") govern your use of the IronSage mobile application and related services (collectively, the "Service"). By downloading, installing, or using IronSage, you agree to be bound by these Terms. If you do not agree, do not use the Service.

License to use

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to:

• Download and install IronSage on Android devices you own or control
• Use the Service for personal, non-commercial fitness tracking purposes
• Access your workout data and related features

This license does not permit you to resell, redistribute, or commercially exploit the Service.

Acceptable use policy

You agree not to:

• Reverse engineer: Decompile, disassemble, or attempt to derive the source code of IronSage, except as permitted by applicable law.
• Abuse the service: Use automated systems (bots, scrapers) to access the Service, or attempt to overwhelm our servers.
• Circumvent security: Bypass authentication, encryption, or other security measures.
• Violate laws: Use the Service for any illegal purpose or in violation of any local, national, or international law.
• Infringe rights: Upload content that infringes intellectual property rights, privacy rights, or other rights of third parties.
• Harm others: Harass, threaten, or harm other users if sharing features are enabled.
• Impersonate: Falsely represent your affiliation with any person or entity.

User content & data

You retain ownership of all workout data, notes, and content you create in IronSage ("User Content"). By using the Service, you grant us a limited license to:

• Store and process your User Content to provide the Service
• Back up your User Content for reliability and disaster recovery
• Use anonymized, aggregated data for service improvements (no personal data is shared)

You are responsible for maintaining backups of your User Content. While we strive for reliability, we are not liable for data loss.

Health & fitness disclaimer

IronSage is not a medical device and does not provide medical advice. The Service is intended for general fitness tracking purposes only. You should:

• Consult a healthcare professional before starting any exercise program
• Not rely on heart rate data or workout metrics for medical diagnosis or treatment
• Stop exercising and seek medical attention if you experience pain, dizziness, or discomfort
• Understand that exercise involves inherent risks

You use IronSage and engage in physical activity at your own risk. We are not liable for any injuries or health issues arising from your use of the Service.

Changes to service & terms

We reserve the right to modify or discontinue the Service, or update these Terms, at any time. Material changes will be communicated via:

• In-app notification
• Email to your registered address
• Notice posted on ironsage.xyz

Your continued use of IronSage after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

Account termination

Your rights: You may stop using IronSage and delete your account at any time via Settings → Account → Delete Account. Upon deletion:

• Your account and synced data will be permanently deleted within 30 days
• Local data on your device will remain until you uninstall the app or clear app data
• Some data may be retained in backups for up to 90 days for security and legal compliance

Our rights: We may suspend or terminate your access to the Service if you:

• Violate these Terms or our Acceptable Use Policy
• Engage in fraudulent or illegal activity
• Pose a security risk to the Service or other users
• Have not used the Service for 24 months (after email notification)

We will provide reasonable notice before termination unless prohibited by law or in cases of serious violations.

Disclaimers & limitation of liability

No Warranty: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IRONSAGE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, use, or goodwill
• Service interruptions or data loss
• Injuries or health issues arising from exercise or use of fitness features
• Unauthorized access to your account or data
• Third-party actions or content (e.g., Health Connect, Bluetooth devices)

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (IF ANY).

Some jurisdictions do not allow limitations on implied warranties or liability for certain types of damages, so these limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless IronSage and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

Dispute resolution & governing law

Governing Law: These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of laws principles.

Informal Resolution: Before filing a legal claim, you agree to contact us at support@ironsage.xyz to attempt to resolve the dispute informally. We will do the same.

Jurisdiction: Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts located in British Columbia, Canada, and you consent to the personal jurisdiction of such courts.

Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and IronSage regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

No Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

Third-Party Services: The Service may integrate with third-party services (e.g., Firebase, Health Connect, Bluetooth devices). Your use of such services is subject to their respective terms and privacy policies. We are not responsible for third-party services.
